Name: To identify users on our platform.
Email address: To communicate updates, payment confirmations, and account information.
Date of birth: To verify age eligibility for our platform.
Payment email (PayPal): For processing affiliate payments securely.
Cookies and tracking data: To improve user experience and track affiliate activity.
IP addresses: To enhance security and detect unauthorized access.
Device/browser details: To provide platform compatibility and resolve technical issues.
Location data: To analyze regional affiliate activity and optimize platform performance.
Affiliates acknowledge that failure to provide accurate and complete information may result in account suspension or termination.
2. How We Use Your Data
The data collected is used for the following purposes:
Platform management and analytics: To ensure smooth operation and monitor affiliate activity.
Tracking affiliate performance: To calculate commissions accurately and assess the effectiveness of referral activities.
Processing payments: To ensure affiliates receive their earnings promptly and securely.
Marketing and promotional efforts: To send relevant updates, promotional content, and targeted offers based on activity and preferences.
Affiliates consent to the Platform’s use of data as described above. The Platform will not sell or share personal information with third parties without explicit consent. However, the Platform reserves the right to provide any data requested by legal authorities, including but not limited to courts of law or other government entities.
3. Data Storage and Security
We currently do not use encryption for data storage. However, affiliates are encouraged to use secure systems to protect their accounts. The Platform may consider implementing encryption tools, such as Let’s Encrypt (a free SSL encryption solution), in the future to enhance data protection.
The Platform disclaims all liability for data breaches resulting from affiliates’ failure to use secure systems or unauthorized access caused by negligence.
4. Data Protection and Retention
Data Protection: The Platform employs industry-standard practices to protect collected data from unauthorized access, alteration, or destruction. Affiliates are responsible for maintaining the confidentiality of their login credentials.
Data Retention: The Platform retains affiliate data as long as necessary to fulfill its purposes, including but not limited to compliance with legal obligations, dispute resolution, and enforcing agreements. Once data is no longer required, it will be securely deleted or anonymized.
5. Cookies and Tracking Technologies
Cookies: The Platform uses cookies to enhance user experience, track affiliate activity, and gather analytics data. Cookies are small text files stored on users’ devices that allow us to recognize returning users and optimize platform performance.
Types of Cookies: The Platform uses both session cookies (deleted after closing the browser) and persistent cookies (remain on your device until deleted).
Cookie Management: Affiliates can manage cookie preferences through their browser settings. However, disabling cookies may affect platform functionality.
6. Age Restriction
Affiliates must be 18 years of age or older. The Platform strictly prohibits the registration or participation of individuals under the age of 18. Any accounts found violating this policy will be terminated immediately. Affiliates found assisting minors to bypass this restriction will face permanent bans and potential legal action.
7. Compliance
The Platform reserves the right to comply with local, regional, or international regulations as deemed appropriate, including but not limited to data protection laws and financial reporting standards. Affiliates are expected to adhere to all applicable laws and regulations when using the Platform.
Failure to comply with legal requirements may result in account suspension, termination, and reporting to relevant authorities, including but not limited to local or international law enforcement agencies.
Terms and Conditions of Use
These Terms and Conditions (“Terms”) govern your use of Prozenya . By accessing or using our platform, you agree to comply with these Terms.
1. Purpose
The Platform is designed to facilitate affiliate marketing by enabling affiliates to earn commissions through referral activities. The Platform does not guarantee earnings or affiliate success and disclaims liability for underperformance caused by affiliate actions or external factors.
2. Approval or Rejection of Affiliate Applications
We reserve the right to approve or reject any affiliate application at our sole and absolute discretion. Affiliates have no legal recourse against the Platform for the rejection of an application.
3. Commissions
Commission Payment: Commissions will be paid once a month. Affiliates must ensure their referred accounts remain active for a minimum of 31 days to qualify for commissions.
Restrictions: Affiliates cannot refer themselves and will not receive commissions for their own accounts. Payments will only be sent for completed transactions. Transactions resulting in chargebacks or refunds are excluded from payouts.
4. Affiliate Obligations
Accurate Information: Affiliates must provide accurate and truthful information during registration. Any falsified information may result in account termination.
Prohibited Activities: Affiliates are strictly prohibited from engaging in:
Inappropriate advertisements, including false claims or misleading hyperlinks.
Spamming (e.g., mass emails or newsgroup postings).
Advertising on sites promoting illegal activities or inappropriate content.
Failing to disclose affiliate relationships for promotions that qualify as endorsements under applicable laws or regulations.
Violations of intellectual property rights.
Offering rebates, kickbacks, or unauthorized incentives from affiliate commissions.
Self-referrals, fraudulent transactions, or suspected affiliate fraud.
Affiliates found violating these obligations will forfeit commissions and face account termination without notice. The Platform reserves the right to report such violations to relevant authorities for further investigation and legal action.
5. Affiliate Links
Affiliates may use graphics and text links provided by the Platform or create their own, provided they comply with the guidelines outlined in the Termination section.
Unauthorized or misleading use of affiliate links will result in immediate removal from the program.
6. Coupon and Deal Sites
Affiliates may not promote unauthorized coupons or deals. Misleading text, pop-ups, or unauthorized actions that set affiliate cookies without clear user intent are prohibited.
Violations will result in immediate removal from the affiliate program.
7. Pay-Per-Click (PPC) Policy
PPC bidding is not allowed without prior written permission from the Platform. Unauthorized PPC campaigns will result in termination of the affiliate account.
8. Liability
The Platform is not liable for indirect or accidental damages, including but not limited to tracking failures, loss of database files, or harm to the program or website(s). The Platform does not guarantee uninterrupted or error-free operation of its services.
9. Termination
Affiliates may be suspended or terminated for violations, including but not limited to those listed above.
The Platform reserves the right to terminate any affiliate account at any time, with or without cause.
Affiliates agree that termination of their account will result in the forfeiture of any unpaid commissions.
10. Indemnification
Affiliates agree to indemnify and hold harmless the Platform and its affiliates, officers, directors, employees, and authorized agents from any claims, liabilities, damages, or expenses arising from the affiliate’s negligence, misrepresentation, or violation of this agreement.
11. Changes to Terms
The Platform reserves the right to modify these Terms at any time without prior notice. Continued participation in the affiliate program constitutes acceptance of any changes.
